Mass Highway Department, Request for Emergency Certification, Route 7-Drainage improvement.

Site visit was held on August 5, 2009, Russ Hopkin and Amer Raza of Mass Highway were present along with NC, JS, TF, VA and DL.

Representing Mass Highway was Amer Raza.  

DL expressed concern that this work could increase drainage downstream causing damage to other properties, therefore suggested that the Commission require that Mass Highway be responsible for remedial action should that occur.

DL made a motion to issue an Order of Conditions with the special condition that the post construction flow rate be the same as original design and that Mass Highway notify the Commission when work is complete for inspection.  JS seconded the motion and the Commission voted to approve 6-0.

Notice of Intent, Eric Taylor, 439 Pittsfield Road LLC, 439 Pittsfield Rd., Map 33 and portion of Lot 1. Construction of three lane driveway access for drive-up windows and ATM machine.  (Continued from July 2, 2009 and July 16, 2009.)

Present were Matt Puntin, Brett Kaminski, and Jim Scalise of SK Design Group and Eric Taylor, principal.

Matt Puntin submitted revised plans and updated information to the Commissioners.  Revisions included the new location and increase in the number of underground chambers, revised river front area; and 2 small restoration areas in the parking lot.  He also went over the comments from DEP and gave satisfactory responses to the information requested.  

TF had a concern about the soil composition under the new location for the holding chambers and the decision was made to put in an additional test pit prior to the construction to make sure the soil would drain properly.

DL made a motion to accept the revised plans and issue the Order of Conditions.   RFC seconded and the Commission voted 6-0 to approve.

Notice of Intent, Town of Lenox for (Route 183) West St.   The proposed project within the buffer zone is roadway reclamation, drainage and sewer impovements, sidewalk improvements, and pavement markings and signs.Continued from July 16, 2009.

Presenting the NOI was Marc Levasseur of Foresight Land Services and DPW Superintendent Jeffrey Vincent.

There was a site visit on July 23, 2009 and was attended by Marc Levasseur, Jeff Vincent, and the following Commissioners:  NC, JS, TF, VA.  

Mr. Levasseur presented revised plans which depict a larger mitigation area than originally proposed.  

DL made a motion to approve the revised plans with a special condition that after hours, whenever practical, the construction trucks and vehicles be moved. to designated parking out of the resource areas.  VA seconded the motion and the Commission voted to approve 6-0.

Minutes:  RFC made a motion to approve the minutes of July 16, 2009 with one edit and JS seconded the motion.  The Commission voted 6-0 to approve.  

RFC made a motion to adjourn and JS seconded.  The Commission voted 6-0 to adjourn at 8:30 p.m.
